Terms & Conditions
1.1 Who we are. We are HarperCollins Publishers Ltd (“HarperCollins/Us/We/Ours”) of 103 Westerhill Road, Bishopsbriggs, Glasgow, G64 2QT whose principal place of business is the News Building, 1 London Bridge Street, London SE1 9GF. Our company registration number is SC 027389.
1.2 How to contact us. You can contact us via the Help page or by writing to us at We Love Romance, Customer Services, 103 Westerhill Road, Bishopsbriggs, Glasgow, G64 2QT.
1.3 How we may contact you. If we have to contact you we will do so by writing to you at the email address or postal address you provided to us in your order.
1.4 ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
2.1 What these terms cover. These are the terms and conditions on which We supply the ebook subscription service (We Love Romance) to you and that you agree to (“the Agreement”).
2.2 Why you should read them. Please read these terms carefully before you order. These terms tell you who we are, how we will provide the We Love Romance content to you, how we may change the Agreement, how you or We can end your subscription, what to do if there is a problem and other important information.
2.3 Agreement to these terms. By using We Love Romance you are agreeing to (i) these terms and conditions; and (ii) that you are entering into the Agreement.
3.1 Free Trial. We may offer you a Free Trial to test We Love Romance. We offer the Free Trial at our sole discretion and we may limit your eligibility, for example if you or someone in your household has already had a Free Trial. If you take advantage of a Free Trial we will ask for your payment details but you can change your mind at any time during the Free Trial, at no charge. You do not pay anything until the day after your Free Trial ends at which point you will be charged as per the payment plan you have signed up to.
3.2 Payment. There are currently two options available to sign up and start your We Love Romance subscription: Monthly Plan: pay a monthly payment and you can cancel anytime by giving one month notice; and an Annual Plan: pay an upfront, one-off, non-refundable, annual subscription. We reserve the right to change these plans or add new plans at a later date.
3.3 How we will accept your order. Our acceptance of your subscription will take place when we send you an order confirmation email (“Your Order”). Your Order email will include your subscription confirmation and a link to direct you to a page that explains how to download the service. When you get this email the Agreement will come into existence between you and Us.
3.4 How to pay. In order to use We Love Romance you must provide payment details. Payment methods are shown on the subscription sign-up page. If you select the Monthly Plan, we will deduct the money from your account every 30 days. You will be charged for your use monthly in advance. The first payment shall be deducted the day after the Free Trial ends. You will then be charged every 30 days unless you pause your subscription. You cannot download any updated content unless you have paid your monthly subscription.
3.5 Price changes. If we increase the price at any time we will give you 30 days notice, in advance. This will give you time to cancel the Agreement if you are not happy with the price increase. Unless you cancel the Agreement before the new price is deducted, we will assume you accept the price change.
3.6 Advance notice of payment due. You will receive an email to remind you when payment is due approximately three (3) days before the payment leaves your account.
3.7 Term. You will be able to access the We Love Romance service and all the eBooks on it until your subscription is terminated.
3.8 If we cannot accept your order. If we are unable to accept your subscription we will inform you in writing and you will not be charged.
3.9 The content is only available to residents in the UK and Ireland.
4.1 Registration, Passwords and Security. When you create an account, you will be required to set up a password and user name to access the service (your “Log-In Details”).
4.2 Maintaining Log-In Details. You are responsible for keeping your Log-in Details secret and secure. You agree not to share them with anyone else - you are responsible for anything that happens in your account. We won’t check the identities of people using We Love Romance and will not be responsible for damage or harm suffered by you if your Log-in Details are used by someone else unless this is due to our negligence. You agree to notify us immediately if you become aware of or suspect any unauthorised use of your Log-In Details.
4.3 Information provided by you. You confirm that you are over 18 and you confirm that all information you provide to us (including on registration) are true, accurate and up to date in all respects and at all times.
4.4 You can update or correct your personal details at any time by amending your account details in the My Account section.
4.5 Your conduct. You agree that in using We Love Romance you will not:
(a) use We Love Romance for any illegal purpose;
(b) do anything to interfere with, harm or prevent access to We Love Romance in any way;
(c) use We Love Romance or the content on it for any purpose other than your own personal non-commercial use.
4.6 Our Intellectual Property. We own all the rights in the We Love Romance Service and the content on it, by entering this Agreement we are giving you a licence to use the service and content for as long as your subscription lasts but at no stage do we grant you ownership of any of the content, including the eBooks. When you are using We Love Romance you can access all of the content on the service for your own personal enjoyment. You must not copy any of the content or remove it from the service itself for any purpose. We own all the intellectual property rights in the content on the service including, without limitation, copyright in the eBooks, trade marks, logos, graphics, photographs, animations, videos etc. You agree not to archive, reproduce, distribute, change, display, perform, publish, license, create derivative works from, offer for sale, or use any of the content service without our permission. You also agree not to decompile, reverse engineer or disassemble any software used in the service.
5.1 Changes to the We Love Romance Service. From time to time we may update, or require you to update, the We Love Romance service. This might involve downtime on the app and/or the Service. We will always try to give you advance notice. This could be for different reasons such as:
(5.1.1) to reflect changes in relevant laws and regulatory requirements for example, we may need to change the level of detail we hold about you, your account details and or any relevant regulatory changes;
(5.1.2) or to implement technical adjustments and improvements, for example to address a security threat.
We shall try to ensure (if it is possible) that these changes will not affect your use of the We Love Romance content and that the We Love Romance service matches the description of it that we provided to you before you subscribed.
5.2 ebooks. We will regularly refresh the content that is available on the We Love Romance service both removing and adding content.
5.3 Title selection: As per clause 5.2 we will update content on a regular basis. Although this is unlikely there may be occasions where we are required to remove a title, immediately, in response to legal notices or regulatory changes. We shall always try to notify you in advance, where possible.
5.4 Update to these Terms and Conditions. From time to time we may update these Terms and Conditions. It is up to you to check for updates and by continuing to use the We Love Romance service you are agreeing to any updated terms.
(6.1.1) Apple Devices Only: The We Love Romance app is available for those with Apple iPhones or iPads or Android phone or tablets. The We Love Romance app can be downloaded from the Apple App store by clicking on this link or from the Google Play store by clicking this link.
(6.1.2) Operating System: Please ensure you keep your device up-to-date with the most recent iOS or Android software updates. In order to use the We Love Romance app successfully, you need to ensure that you have version 10 or above.
(6.1.3) Multiple Devices: You can download the We Love Romance app to a maximum of six devices. You can only be logged in to the We Love Romance app on one of those devices at any one time. If you are logged in on your mobile phone and you try to log in on a tablet, you will be automatically be logged out of the page on your mobile phone.
6.2 Offline Access: You can download an ebook to your account to read offline. You continue to have access to your library for as long as you continue to pay your subscription. You have continuous offline access for 24 hours. After 24 hours, you are required to authenticate your account. This means you must ensure that you have access to Wi-Fi every 24 hours in order to sync your account to the We Love Romance service. If you pause your account you lose access to your library from the point at which your next payment was due.
6.3 When Things Go Wrong. Whilst we work hard to keep the We Love Romance service up and running we are reliant on other service providers who may occasionally experience difficulties. If your access to We Love Romance is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be responsible for delays to access caused by the event, but if you wish you may contact us to terminate your subscription.
6.4 We may suspend your access to the We Love Romance service (we will contact you to tell you if we need to do so) for reasons, including:
(6.4.1) to deal with technical problems or make minor technical changes;
(6.4.2) to implement improvements, bug fixes and enhancements to the functionality and customer experience of the app;
(6.4.3) to implement improvements, infrastructure upgrades and development of the connected services including those of third party service providers;
(6.4.4) to follow up with you to confirm details we need from you;
(6.4.5) if your payment has not been received;
(6.4.6) to update the We Love Romance to reflect changes in relevant laws and regulatory requirements;
(6.4.7) and to make changes to We Love Romance as requested by you or notified by us to you (see Clause 5).
7.1 How to cancel: You can cancel your Monthly or Annual Plan subscriptions at any time when you are paying subscriber - for cancel instructions please see 7.5 - and in the following circumstances:
(7.1.1) At any point during your Free Trial. We will send you an email near the end of your Free Trial to remind you that it is coming to an end. We will then deduct the amount due from you once the Free Trial is over.
(7.1.2) If we have materially changed the We Love Romance Service or content so that it does not resemble the service that was described before you subscribed.
(7.1.3) If the We Love Romance Service is unavailable due to a technical fault or other problem at our end.
(7.1.4) If we gave you the wrong price for your We Love Romance subscription or we increase the price of your subscription.
7.2 If you decide to cancel your subscription because of a material change to the service or pricing error we will refund you the pro-rata amount for the unused period of your subscription.
7.3 Option to Pause: You can pause your subscription at any time during your Monthly Plan, simply sign in at weloveromance.com. Go to My Account and click on ‘Pause Subscription’. Your subscription will be paused at the end of your current term. To resume your subscription, simply click on ‘Resume Subscription’ in the My Account section and your subscription will resume immediately. If you pause your subscription we will not take money from your account and your payments will resume when you unpause.
7.4 Re-subscribe: The pause option provides you with flexibility. You can re-subscribe at any time within twelve months from deciding to pause your account, without the need to re-enter your details and without losing access to your collection of titles.
7.5 Option to Cancel: You can cancel your subscription at any time during your Monthly Plan, simply sign in at weloveromance.com. Go to My Account and click on ‘Cancel Subscription’. Your subscription will be cancelled at the end of your current term. If you'd like to subscribe again, simply sign in and click on the ‘Start14-Day Free Trial’ and fill in your details again.
7.6 We may cancel your Monthly or Annual Plan if you break the terms of this Agreement including, but not limited to:
(7.6.1) If you fail to make a payment when due and when reminded;
(7.6.2) If you provide us with incorrect information, such as your billing address, and do not correct it; or
(7.6.3) If you breach any of the terms set out at 4.5 (above).
7.7 If we cancel your subscription as a result of you breaching the terms of this agreement, we may refund any money you have paid in advance for an Annual Plan pro rata for the time you cannot use. However, this is at our discretion. We may be required to deduct a £7.99 administration fee for the costs we will incur as a result of us cancelling your subscription. No monies will be repayable for a Monthly Plan cancellation.
7.8 We may withdraw the We Love Romance Service. In the unlikely event that we withdraw the We Love Romance service we will contact you in advance of our stopping the supply of the service and will refund pro rata any sums you have paid in advance for your Monthly or Annual Plan.
8.1 We will provide updates to the service on a regular basis. It is your responsibility to keep your We Love Romance updated on your personal device(s). We are only responsible to you for loss or damage to a device belonging to you in the unlikely event that it is proven to be directly caused by We Love Romance. It is very unlikely that this would occur but if you have problems with your We Love Romance account do let us know as soon as possible. If it transpires that your loss was directly caused by something we did, we may give you compensation up to a maximum of £96.
9.1 How we may use your personal information. We will only use your personal information as set out in our https://www.harpercollins.co.uk/corporate/privacy-policy
9.3 For more information on cookies and how to disable them, You can consult the information provided by the Interactive Advertising Bureau at allaboutcookies.org.
10.1 Nobody else has any rights under this Agreement. This Agreement is between you and us. No other person shall have any rights to enforce any of its terms.
10.2 If a court finds part of this Agreement illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
10.3 Even if we delay in enforcing this Agreement, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this Agreement, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide access to the service, we can still require you to make the payment at a later date.
10.4 Which laws apply to this Agreement and where you may bring legal proceedings. We will try and solve any issue you have. If you are not happy with the way we deal with any issue and you want to ask a court to investigate. The court you use for a complaint depends on where you live:
